Does the Korean court make a fair judgement in civil litigation? For
answering to this question, I defined fairness as consent of litigants to the
judgement, and measured the level of consent using appeal rate. The appeal
rate of civil litigation in Korea is not particularly higher than that of Japan,
which belies the popular belief. However, continuing effort to enhance the
level of fairness should be made. For this regulations on supply of lawyers
should be abolished, and enough number of judges should be hired.
Regression analysis supports this argument.
